I understand you all admire RBG in so far as I do. I came across the following very interesting piece of info. Take a look!

“The lead opinion uses one term, “strict scrutiny,” to describe the standard of judicial review for all governmental classifications by race. But that opinion’s elaboration strongly suggests that the strict standard announced is indeed “fatal” for classifications burdening groups that have suffered discrimination in our society. That seems to me, and, I believe, to the Court, the enduring lesson one should draw from Korematsu v. United States (1944) [permitting Japanese internment]; for in that case, scrutiny the Court described as “most rigid,” nonetheless yielded a pass for an odious, gravely injurious racial classification. A Korematsu-type classification, as I read the opinions in this case, will never again survive scrutiny: Such a classification, history and precedent instruct, properly ranks as prohibited.”

On Oral Arguments…

SCALIA: When I first came on the court very few questions were asked. I argued before the Court once before I became a judge and I got only two questions. I think it was two, maybe three. All of them from Byron White, in the whole time I argued. Nowadays, wow, the whole process consists of responding to questions from the Court…I think that latter is better.

C-SPAN: “Did you start it?”

SCALIA: “I was the first one who started asking a lot of questions, I guess. And that was probably my law school background, my law professor background and then when other former law professors came on the Court they continued the same, Ruth Bader Ginsburg of course another former law professor, Stephen Breyer another former law professor.”

On personal relationships…

C-SPAN: Has there ever been in your past when you make some strong statement, personal fallout from that?

SCALIA: I’ve criticized the opinions of some of my colleagues and we have remained friends just as they have criticized my opinions and we have remained friends. Look, this is the kind of a job if you can’t disagree, even disagree vehemently, on the law without taking it personally and without hating the person who’s on the other side you ought to find another job. That’s it.

John Paul Stevens has a new book, and other stuff

I love Supreme Court justices with sass, and sass from retirement is just as good. John Paul Stevens, who left the Court in 2010, has written a new book, Six Amendments: How and Why We Should Change the Constitution, which will be published later this month, two days after the former justice turns 94 (94!). For the New York Times Book Review, JPS answered a series of insipid questions that the Book Review posed to him.
In his responses, Stevens showed that he is well-versed in shameless self-promotion. When asked what one book he would require the president to read, JPS responded that he would have the president read his new book, Six Amendments. I really love that. No façade of wisdom or thoughtfulness; just pure marketing. I guess once you’re a nonagenarian, there’s really no reason to feign modesty. And I liked that he answered that what he plans to read next are reviews of his new book. This is a man who knows what really matters: book sales. Buy this book. An elderly veteran needs your support.And by the way, Justice Stevens, I will gladly accept a free review copy of Six Amendments. I promise I’ll write a glowing review in which I exalt you and your unearthly brilliance, while scorning the contemptible stupidity of your former colleague, Justice Scalia (because we all know you hate him, and he deserves it).
I wish RBG would write a book. Other than, of course, her classic 1965 volume, Civil Procedure in Sweden.
While I’m rambling on, I’ve had a  few other ideas for Supreme Court-related blogs. One would be for posts about the non-Real Bad Gangsta justices and other general SCOTUS goings-on. Though I occasionally focus on other justices in some posts on the GinsBlog (like this post on Stevens), I feel that’s a betrayal of the site’s true purpose: celebrating everything amazing about Ruth Bader Ginsburg. But keeping up a blog takes effort and time and stuff, and like, who has those things?
I’ve also thought of creating a site for Supreme Court fanfiction, involving stories where, for example, Justice Ginsburg flies across the land on her rainbow-trailing unicorn, spreading feminist jurisprudence to all those in need and fighting the evil arch-conservative forces of Chief Justice Roberts. And that site would probably also include descriptions of Supreme Court dreams, because I’ve had what is, honestly, an embarrassing number of Supreme Court dreams that I feel I need to share, and the GinsBlog is just not the right forum.
  Would anyone visit those sites? Would anyone want to write for them? Is anyone reading this? Share your thoughts in the comments section. (Seriously, leave comments. They can be anonymous, profane, insulting, I don’t care.)

Elena Kagan became only the fourth woman to be appointed as a judge to the US Supreme Court on Saturday, as she was sworn in as the 112th Justice at a ceremony in Washington DC.
Chief Justice John Roberts administered the oath to Kagan in a ceremony at the court.
Joined by family and friends, Kagan pledged in the oath to faithfully and impartially uphold the law.
Afterward, she smiled broadly as onlookers stood and applauded.
The former Harvard Law School dean was most recently solicitor general.
President Barack Obama chose her to succeed retired Justice John Paul Stevens.
Republicans have criticised her as a political liberal, but the Senate confirmed her appointment with a vote of 63-to-37.
Kagan won’t be formally installed as a justice until October 1 in a ceremony at the start of the court’s new term.
However she will be able to begin assuming her duties as a justice, which include reviewing cases and emergency appeals filed to the Supreme Court.
Kagan, 50, joins female Justices Ruth Bader Ginsburg and Sonia Sotomayor on the nine-member court.
The first woman in the court’s history, Justice Sandra Day O’Connor, retired in 2005.
